Richard Reeve-Young has co-authored an article published in the Intellectual Property Magazine’s April edition and titled “Chain gangs” which deep dives into the Intellectual Property issues that arise in connection with cryptocurrencies.
The article considers the patentability of cryptocurrencies, how they inter-link with trade marks and passing off and whether copyright and database rights may provide any protection.
Understanding IP rights subsisting in cryptocurrencies is not only relevant to IP/IT litigation, it is also important in mainstream commercial litigation (eg, for determining whether cryptocurrencies amount to property against which a judgment creditor might enforce). Lawyers will increasingly have to grapple with blockchain technologies in the future and related IP rights will need to be at the forefront of their thinking.
